This is a Cooper's Hawk. You can see the dark cap and the pale nape, indicative of a Coop. There are many other factors contributing to the birds ID. Send photos like these to Jerry Liguori, or post them on the Ubird list serve. He loves to be of help, and is a national authority on the matter. It is a tricky one for sure, but he is great at articulating the differences and breaking it down for you.
